Whether the races mind depends on what you are capturing. If you attack the ships from a factory in the same sector, don't be surprised if they launch their fighters to defend it. You don't get any credit for capturing any ships but if you attack ships belonging to a specific race then your rating with them will drop. If you kill the ship or an ejected pilot then you'll suffer a more significant drop. The good news is that nobody cares about pirates except their comrades.
The "capturing code" is a honorary code whereby if you surrender your ship, you should be left to fly another day. Not everyone follows this code and the authorities can take a dim view of anyone caught killing their pilots. Expect a drop in race ranking for attacking their ships and a more significant one for killing the pilot regardless of whether they are in the ship or in space.
